Australia Temporary Skill Shortage or a 482 Visa is a work visa you can apply for if you have a sponsor who nominated you for this visa. Your sponsor needs to prove that they need a foreign worker for this
position.
This visa allows employers to address workforce shortages by nominating skilled foreign workers when they cannot find suitably qualified Australian workers.

482 Visa streams

While applying for this visa, you need to consider which stream is more appropriate for you. There are three different streams to this visa:

Short-term stream: With this stream, you are allowed to work in Australia for two years, or up to four years, considering your situation (including International Trade Obligation). Hong Kong Passport holders are allowed to stay up to five years. With this visa, you are allowed to travel from and to Australia as many times as you desire while your visa is valid.
Eligible Temporary 457 and TSS visa holders are allowed to apply through the Employer Nomination Scheme (ENS), Temporary Residence Transition (TRT) stream. It is only accessible for two years from its beginning on July 1, 2022. See ENS/TRT for more information.

Medium-term stream: This stream allows you to work and stay in Australia for up to 4 years, and in case of eligibility, you can apply for a permanent residence visa. Labor agreement stream: If your sponsor is a part of the labour agreement, you can apply for this stream. The labour agreement represents a correspondence between an Australian employer and the Australian government, allowing businesses to bring workforces to Australia considering the specifics of the labour agreement. You are entitled to stay up to a maximum of four years according to labour agreement terms. With this visa, you are allowed to travel from and to Australia as many times as you desire while your visa is valid. Hong Kong Passport holders are allowed to stay up to 5 years. You can study, but there will be no government assistance.

Checklist of 482 Visa
The followings are essential for your 482 visa application:
Passport and ID: Providing a valid passport and other identification documents required by the Department of Home Affairs are essential, including an ID card, marriage certificate, etc. Qualifications and experience: Submitting documents to prove your qualifications, skills, and experience is essential. You can provide licensing or registration evidence, relevant awards, certificates, former employer references, and resume (CV), etc.
Documents for Skill assessment: You might be required to provide a skill assessment report according to your visa stream. If obligatory, the report shall be attached to your visa application; otherwise, your visa won’t be granted. You shall confirm these requirements with the Immigration office in advance. English proficiency proof: You need to submit evidence proving that you have the minimum English language proficiency required.
Health insurance: Having valid health insurance for the time you stay in Australia is obligatory. Good character evidence: Submit forms 80 and 1221 to prove your good character together with other documents such as police certificates, etc.
Partner’s documents: If you are applying for this visa with your partner, it is essential to submit your partner’s identification documents, marriage license, or registered relationship proof. Also, your partner shall obtain the character requirements.
Minor children documents: You must provide birth certificates, copies of passports and other similar documents for your minor children. It is essential to fill in and submit form 1229, for parental consent, statuary declaration or other forms of consent.
Adult dependent child documents: To apply for children over 18 years old that are depending on you, it is essential to provide their identification documents, their character documents along with form 47, and other evidence of dependency.
Documents of assistance: Please fill in and submit form 956 or form 956a if someone is helping you with your visa application.

Temporary Skill Shortage Visa English Requirements
For this visa, you shall meet at least the minimum English proficiency level. Considering the visa stream that you apply for, the required scores will change.
It Is also required to prove that you reached the score within one attempt of taking the test and that the test was at least taken three years before applying for this visa.

You have proved that you have a higher English proficiency level than the scores required to get the registration, membership, or license.

You are an Australian overseas company or its affiliate entity employee and you are nominated by them to work in Australia, receiving an amount of AUD96,400 annually.

Your sponsor’s document checklist
​
While submitting your nomination, they shall provide the following documents:

Identification documents: The sponsor shall submit your full name, date of birth, and other employment-related documents.

Employment contract: The employer shall submit a copy of your employment contract unless exempt.
-
The AMSR evidence: The person who nominated you for this visa shall prove that they can pay an annual market income that is equivalent to the temporary skilled migration income standard.

Labor market testing evidence: The sponsor shall prove that they have tested the labor market in Australia and that no Australian citizen or permanent resident can hold the nominated position.

Evidence of a genuine position: Your employer shall submit proof that this position nominated for you exists, and you will perform all the responsibilities specified in the contract.

Exemptions proof: In case your sponsor believes that this nominated position is subject to an advertisement and reservation or that testing the labor market is not essential, they shall provide proof that they are excluded and excused from the requirements.
Visa 482 eligibility criteria

The Eligibility Criteria for a Visa 482 are as follows:
You are nominated for this occupation by an eligible employer.

You are employed in the nominated occupation and have worked for your employer

Before applying for a 482 visa, you worked for your nominated occupation for at least two years.

You are a holder of a Substantive or Bridging Visa, A BVB, or BVC (if applying from Australia).
For a short-term stream visa:

Your employer has nominated you for a position on the STSOL short-term skilled job list (see list).

482 Visa application process:
By following the instructions below, you can apply for visa 482:
-
The sponsor shall apply for sponsorship.
-
The sponsor shall be approved.
-
The sponsor shall nominate you for this visa.
-
The sponsor shall pay the levy fund.

You can apply for this visa.

The sponsor applies for the sponsorship.
Before applying for a 482 visa, the sponsor shall apply to become a standard sponsor. (if they are not already) Sponsors must submit an online application for their sponsorship through ImmiAccount and provide the required documents. They are also required to pay a sponsorship fee of AUD 420.
The sponsor does not have to apply to become an eligible sponsor if you are applying for the labor agreement stream. However, the employer shall be a part of the labor agreement or shall apply to be a part of the labor agreement.
The sponsor is approved
As soon as the sponsor is approved, the sponsorship is valid for five years. The employer can then apply for a nomination application for you to grant this visa.

The Sponsor Nominates You for this Visa
Once your employer has become an approved sponsor, they can apply for nomination on your behalf. They shall nominate you through ImmiAccount and shall pay a nomination fee of AUD330.
The Sponsor Pays the Levy Fund
The Skills Levy Fund shall be paid as soon as the sponsor initiates the nomination process. The total amount of the fund is calculated on the nomination form, but the fees vary depending on the hugeness of the companies and the working duration.
A small company with a turnover of less than AUD 10 million will have to pay an annual membership fee of AUD 1,200, and a company with a turnover of over AUD 10 million will have to pay AUD 1,800. For instance, if the sponsor has a company with a turnover of AUD 9 million and you have been employed by them for three years, then the levy funds will be AUD 5,400.

How much does this visa cost?
The cost of a 482 visa is AUD$ 2,690. If sign up for the short-term stream, you shall pay AUD 1,290. Please note that you shall pay an additional fee for each family member added - see the complete list of fees.

How to get a skill assessment for this visa?
You shall undergo a skills assessment through the Temporary Skills Shortage Visa Skills Assessment Program - see the program here.
Depending on the profession you are nominated for, you shall submit a skill assessment via VETASSESS or Trades Recognition Australia.
To find out if a skills assessment is required, you should contact the Immigration Bureau before applying. Your application is invalid if you do not complete these procedures before applying for a visa. The immigration office will also inform you where you can get your skills assessment.

How long does a 482 visa allow me to stay?
In general, a 482 visa allows you to stay for up to four years. In case you have a short-term Stream 482 visa, your visa is valid for 2 years. Short-term stream visas are valid for four years if the ITO is applied to the visa.
ITO or International Trade Obligations is applied when you are:
An intra-company transferee.
Intra-company transferees from Singapore or Thailand.
A Chinese citizen.
Independent executive.
Contractual supplier.
Contractual suppliers from Thailand.

Does a 482 visa allow me to stay longer?
Yes. In case your visa is about to expire, and you are still working for your employer, you can apply for another visa. To grant another 482 visa, your employer shall submit a new form for your nomination and reapply for your visa.
Visa 482 after PR (permanent residence)
You are allowed to get a permanent resident visa if you are nominated for one of the following visas by your employer:

Employer Nomination Scheme Visa 186.

Regional Sponsored Migration Scheme Visa 187.
You can apply for a Permanent Resident visa only through a subclass 186 visa if you have a current labor agreement stream.

Can family members be included on a 482 visa?
Yes, you can apply with an immediate family member.

Spouse or de facto partner.
-
Your minor child or your partner's minor child;
-
Your adult dependent child or your partner's adult dependent child.
-
Your grandchildren or your partner's grandchildren (minor or dependent).
If you were formerly granted a 457 a TTS visa, you are allowed to include family members who have TTS visas as they are a part of your family. Please note that these children are all legally recognized as children, adopted or stepchildren, etc.
Also, please note that dependent children are required to prove that they genuinely depend on you or your partner mentally, financially, physically, or socially.
482 Subsequent visa

You are not able to add family members after applying for this visa. However, if the application is in the process by the ministry, family members can apply for the visa as latecomers but must apply online and pay the fee for the visa. This is for family members of subclass 482 and 457 visa holders. You can stay as long as your visa is valid. With this visa, you are allowed to travel from and to Australia as many times as you desire while your visa is valid.

482 Visa Requirements
After a 482 visa has been granted, the following conditions must be met to maintain it:

You must start working within 90 days of arriving in Australia or after receiving your visa (if applied locally).

You can only work in the occupation you are nominated for.

You cannot be absent from work for more than 60 days consecutively.

You can only work for the company that nominated you (unless you are excused)

Can I change employer on a 482 visa?
No, to change your employer, you are required to apply for this visa again. Please note that your new employer will need to submit another form for nomination and have it approved before you can start working for them.
Can I change jobs with a 482 visa?
No, you are only allowed to work the same occupation you were nominated for when you were granted this visa. If you wish to change your occupation, you shall apply for another temporary skilled shortage visa.
Temporary Skilled Migration Income Threshold (TSMIT)
Your employer shall be able to pay standard market annual wages equal to the Temporary Skilled Migration Income Threshold. The amount is currently AUD 53,900. However, other benefits such as accommodation and cars are not included in this amount.
